Carmody MacDonald Secures Full Payment in Mechanic's Lien Case

General contractor held accountable for not paying for pre-engineered building

ST. LOUIS, December 11, 2020 – In a recent case in Newtown County, attorney Chris Kellett was able to settle a mechanic’s lien case out of court and obtain full payment for his client prior to the hearing on their summary judgement motion.

The case involved a dispute between a client that manufactures pre-engineered metal buildings and a general contractor who was hired to build a commercial facility for a property owner. The contractor refused to pay for the pre-engineered building it had purchased, so the Carmody MacDonald team put a mechanic’s lien on the property and filed suit for breach of contract against the contractor and to enforce the mechanic’s lien against the property owner. They also filed a motion for summary judgment. As a result, the contractor paid the entire amount due, which was hundreds of thousands of dollars, plus interest to the building manufacturer shortly after.
