Carmody MacDonald Lawyer Wins $494,000 Jury Verdict in Breach of Contract Case

Insurance administrator held accountable for not paying its share of refunds owed to consumers

ST. LOUIS, MISSOURI (April 16, 2018) - In a recent five-day jury trial in St. Louis County, Todd Hamby earned a verdict in a breach of contract case in favor of Carmody MacDonald’s client.

The case involved contract disputes between a local marketer (defendant) and an insurance administrator (plaintiff). The plaintiff in the case sued for $23,000 for overdue payments, and the defendant countersued for $354,000 in part because the plaintiff had been extending expiration dates on canceled contracts in plaintiff’s computer system which improperly reduced the amount of refunds the plaintiff owed under the canceled contracts.

In a post-trial motion, the Carmody MacDonald team also earned the judge’s favorable ruling when he ordered the plaintiff to pay defendant’s attorneys’ fees and court costs in the approximate amount of $140,000.

When asked about the trial win, attorney Todd Hamby shared, “This was a complicated case. Fortunately, the jury was fully engaged and got it right.”
