Gerard T. Carmody has been litigating cases for more than 30 years, trying more than 100 cases to conclusion in state and federal courts. He is a Fellow of the American College of Trial Lawyers. Mr. Carmody concentrates his practice in commercial, real estate and employment litigation. He has acted as lead trial counsel for a variety of clients, including Anheuser-Busch Companies, Inc., The Boeing Company, Biomedical Systems Corporation, Kimco Realty Corporation, Saint Louis University, Washington University, Target Corporation and Westfield Corporation.

For more than ten years, Mr. Carmody has been recognized on The Best Lawyers in America® list. In 2013, he was recognized by The Best Lawyers in America® in the areas of Commercial Litigation, Eminent Domain and Condemnation Law, Bet-The-Company Litigation, Labor & Employment Litigation and Real Estate Litigation. In 2001, 2005 and 2007, he was honored by Missouri Lawyers Weekly as a "Lawyer of the Year." For several years, he has been selected by Missouri Lawyers Weekly as one of Missouri's top three litigators. In 2008, Mr. Carmody was awarded the distinction of "Best Litigator" and "Best Appellate Win" by Missouri Lawyers Weekly. He is regularly selected to the list in Missouri & Kansas Super Lawyers® and has been featured in St. Louis Magazine as one of the "Best Lawyers in St. Louis."

Mr. Carmody is seen as a leader among his peers. In 1999, he was elected by his peers to serve a six-year term on the Missouri Appellate Judicial Commission, which is responsible for nominating judges to Missouri's Appellate and Supreme Courts. Recently, the St. Louis Daily Record published a story detailing the growth of diversity in the courts while Mr. Carmody was on the Commission.

Mr. Carmody's professional legal background is both broad and deep, and he is considered one of the most experienced litigators in the region. He has achieved successful jury verdicts for Fortune 500 companies as well as privately-held entities and government agencies. Among his successes, he secured a record $75 million jury verdict in the Eastern District of Missouri for a medical company. In 2006, he won a $2.3 million jury verdict for the owners of a shopping center who had been offered $100,000 for a portion of their property through a condemnation action. In addition, Mr. Carmody has successfully represented Anheuser-Busch Companies and The Boeing Company, among others, in jury trials regarding employment discrimination matters.

According to Missouri Lawyers Weekly, "[Jerry] is considered by many in his profession to be among the top experts in eminent domain within Missouri." He was chosen by Missouri Governor Matt Blunt in 2005 to serve on a task force to review eminent domain law and procedures. The chairman of the Governor's Task Force on Eminent Domain and general counsel for the governor said that "Carmody was chosen for the task force because of his widespread experience representing both sides in condemnation law, from the property owners to the condemning authorities. He is one of the foremost experts on eminent domain in Missouri, given his broad experience. He has been helpful in identifying problems and coming up with recommendations to solve them."

Mr. Carmody is a former assistant circuit attorney for the City of St. Louis.

Representative Matters

  • Acted as lead counsel for Biomedical Systems Corporation in obtaining a record $75 million jury verdict in a breach of contract trial in federal court.
  • Acted as lead counsel for Westfield Corporation and other plaintiffs in successfully overturning redevelopment ordinances for a highly public and controversial project in Sunset Hills.
  • Acted as lead counsel for developers in multiple redevelopment projects for Wal-Mart, the City of Maplewood, St. Louis University and Washington University Medical Centers.
  • Obtained defense verdict in 2004 retrial of right of publicity case brought by former Blues hockey player, Tony Twist.
  • Represented owners of the Fox Theatre in St. Louis, obtaining dismissal of condemnation action which sought to condemn the theatre. The Missouri Court of Appeals affirmed that dismissal.
  • Obtained summary judgments or jury verdicts for many clients in employment discrimination cases filed in federal and state courts in St. Louis.
